Please read these Terms of Service ("Terms") carefully before using the YardKit mobile application (the "App") operated by BUKNAL ENT. LLC ("we," "us," or "our").
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms.
1. The Service
YardKit is a mobile application that helps homeowners manage lawn care. The "Service" includes personalized care plans, an AR measuring tool, a Plant ID feature, a product locker, and a lawn journal.
You acknowledge that the App is for informational purposes only. All advice, plans, and recommendations are provided "as is." We are not responsible for any damage to your lawn, property, or person resulting from the use or misuse of information provided by the App.
2. Subscriptions & Payments
The App is a "freemium" product.
Free Plan: Users on the free plan are limited to one (1) lawn profile and three (3) Plant ID scans.
Pro Plan: We offer monthly, annual, and lifetime subscriptions ("YardKit Pro") that unlock premium features, including multiple lawns, unlimited scans, and lawn sharing.
Payment: All subscriptions are processed by Apple's App Store ("Apple"). You must provide a valid payment method to Apple.
Auto-Renewal: Monthly and Annual subscriptions will automatically renew unless you cancel them at least 24 hours before the end of the current subscription period.
Cancellation: You can manage or cancel your subscription at any time in your device's Settings > Apple ID > Subscriptions.
•Free Trial: Our Annual plan may offer a 7-day free trial. If you do not cancel before the trial ends, you will be automatically charged for the annual subscription.
Downgrades: If your "YardKit Pro" subscription expires or is canceled, your account will revert to the Free Plan. You will be asked to choose one (1) lawn to keep active. All other lawns will be "locked" (read-only) and premium features will be disabled. We will never delete your data, and you can re-access it by resubscribing.
3. User Accounts
The App uses Apple's CloudKit to store your data in your private iCloud account and Firebase Anonymous Authentication to secure your connection to our backend services. You are responsible for maintaining the security of your Apple ID.
4. CloudKit Sharing
Our "YardKit Pro" plan allows you to share a lawn profile with another user via CloudKit Sharing. You are responsible for who you invite and the permissions you grant.
5. Third-Party Services & Links
The App uses third-party APIs (like Plant.id and Unsplash) to provide features. We do not control and are not responsible for the accuracy, availability, or content of these third-party services. The App may also contain affiliate links.
6. Disclaimer of Warranties
The App is provided "AS IS" and "AS AVAILABLE," without any warranties, express or implied. We do not warrant that the App will be accurate, reliable, secure, or error-free, or that any lawn care advice will lead to your desired results.
7. Limitation of Liability
In no event shall BUKNAL ENT. LLC be liable for any indirect, incidental, special, or consequential damages (including, but not limited to, damage to property, lawns, or personal injury) arising from your use of the App or a ny advice contained within it.
8. Governing Law
These Terms shall be governed by the laws of Florida, United States, without regard to its conflict of law provisions.
9. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms within the App.
